The following terms and conditions apply from 26th September 2011

We know you hate it, we do too, but here's the small print.

It covers your use of our Services and also our website.

We ask you to accept these terms when you sign-up and your activation of a WBSS Profile means that you accept them.

We'll keep these terms and conditions up to date at wbss.co.uk at the link of the bottom of every page. Please check them regularly since by continuing to use our service after a change will mean that you have accepted the change

IMPORTANT: YOUR RIGHT TO CANCEL

You are entitled to cancel this Agreement at any time. By cancelling this Agreement you no longer have the right to use any WBSS Products or Services and any such existing WBSS Products and Services issued to you will be cancelled and/or voided with immediate effect. Any data held about You by WBSS will be handled pursuant to our Privacy Policy.

By opting to cancel this Agreement you are not entitled to a refund for outstanding Products and/or Services.

Please note that by using the Service you will be deemed to have accepted these terms and conditions.

  1. Explanation of Certain Words

    1.1. In these Terms and conditions:

    "Academic Year"
    is defined as the period between the 1st October and the 31st July;

    "Content"
    means textual, visual or other information, software, photos, video, graphics, music, sound and other material appearing on or available through the Service including all information supplied by content providers from time to time;

    "Intellectual Property Rights"
    means: (i) any (and any rights subsisting in any) patents, designs, trademarks and trade names (whether registered or unregistered), copyright and related rights, moral rights, database rights, know-how and confidential information; (ii) all other intellectual property rights and similar or equivalent rights anywhere in the world which currently exist or are recognised in the future; and (iii) applications, extensions and renewals in relation to any such rights;

    "Member"
    a Member of WBSS is defined as someone who has purchased a WBSS Membership card, which is valid for the current Academic Year;

    "Membership"
    having a valid Membership is the corresponding term for being a Member ;

    "Non-Member"
    anyone who has not purchased a WBSS Card, regardless of whether or not they have activated a WBSS Profile Page. Any Non-Member who has activated a WBSS Profile Page is subject to the Terms and Conditions;

    "Participation"
    means Member involvement, such as referring a friend, voting on Society decisions, or answering questions on the Member forum;

    "Provisional Card"
    refers to the Black Card with a code on the front which can be redeemed on wbss.co.uk in order to make you exempt from payment for the WBSS Card;

    "Products"
    include but are not limited to the WBSS Card, Provisional Card and WBSS Clothing;

    "Registration"
    means the creation of a WBSS Profile Page on wbss.co.uk. Not to be confused with becoming a "Member";

    "Rights"
    means copyright, trademark and other relevant proprietary and intellectual property rights relating to Content;

    "Service"
    means any or all (as the case may be) of the following services: provision of Social Events, Corporate and other learning events, including those co-hosted with our Sponsors, the ability to access and use Members only section of wbss.co.uk, offering discounts and other promotions in conjunction with the WBSS Card to our Members . Also includes the provision of WBSS Profile Pages to any Non-Members;

    "Sponsor"
    refers to an organisation who has entered into a contractual agreement with WBSS to provide certain Services, including but not limited to co-hosting events and provision of certain resources and/or personnel, subject to the Terms of the relevant contracts;

    "Terms and conditions"
    means these terms and conditions;

    "Using the Service"
    means from when your WBSS Profile is first activated until such time as it is deleted;

    "Web Services"
    means services provided from our Website and any additional websites linked from our Website.

    "WBSS" "We", "us" and "our"
    means Warwick Business School Society, Scarman Road, Coventry, CV4 7AL.

    "WBSS Card"
    refers to our Black Personalised Membership Card, which is ordered through wbss.co.uk.

    "WBSS Profile"
    refers to Your Profile page found at wbss.co.uk/members provided you have registered with your Facebook Account at wbss.co.uk/members/register.php.

    "You"
    means the person to whom the terms and conditions apply, and it includes a person who we reasonably believe is acting with your authority.

    1.2. All services, offers and promotions are subject to additional terms and conditions advertised in our marketing literature and on our website wbss.co.uk. Please check our site reularly as these terms are updated from time to time.

  2. Provision of Products and Service

    2.1. We may, using reasonable skill and care, exercise our discretion to refuse to provide any part of the Service to you (and this may involve barring certain IP Address from wbss.co.uk on a temporary or permanent basis, in circumstances where it is necessary for us to do so).

    2.3. We will do our best to provide Products or Service to you by any date we have agreed with you but our ability to do so may be affected by circumstances beyond our control and we will not be liable to you if this is the case.

    2.4. wbss.co.uk may from time to time require upgrading, modification, maintenance or other work which may result in partial or complete non-availability of the Service.

    2.5. The Service enables access to Content. You may only use Content in a way that does not infringe the Rights of others ('Approved Use') and you must comply with all other instructions issued by us regarding use of Content. You shall not store, modify, transmit, distribute, broadcast, or publish any part of Content other than for an Approved Use. The re-selling, copying or incorporation into any other work of part or all of the Content in any form is prohibited save that you may print or download extracts of Content for your personal use only.

    2.6. You are solely responsible for evaluating the accuracy and completeness of any Content and the value and integrity of goods and services offered by third parties over the Service. We will not be a party to or in any way responsible for any transaction concerning third party goods and services, except in the case of negligence on our part.

    2.7. If you use the WBSS Service it is a condition of this Agreement that you provide us with a current email address and that you maintain this address and advise us promptly of any changes to it. It is your responsibility to verify that your email mailbox is in proper working order and you must assume the risk of all consequences for errors in sending and receiving email, unless caused by our negligence.

  3. WBSS Membership

    3.1. You become a Member by ordering a WBSS Card on wbss.co.uk.

    3.2. Payment for the WBSS Card is subject to Clause 4, Payment.

    3.3. Membership will last a maximum of one Academic Year.

    3.4. At the end of the Academic Year, all WBSS Memberships in that year are terminated and cannot be renewed until at least the start of the next Academic Year. Subsequently, any Members from that Year will now be Non-Members.

    3.5. Any Non-Members who become so as a result of termination of Membership, be it automatically at the end of the Academic Year or otherwise, are still subject to this Agreement for as long as they continue to use the Services.

    3.6. WBSS cannot be responsible for any loss or damage of WBSS Cards.

    3.7. WBSS handles all Data relevant to Membership in accordance with our Privacy Policy.

  4. Payment to WBSS

    4.1. Payment for WBSS Card may be done either on wbss.co.uk using PayPal or by purchasing a Provisional Card from a WBSS Exec Member.

    4.1.1. We will not have any obligation to make a refund to you where you purchase more WBSS Cards or Provisional Cards than you intend, for whatever reason.

    4.1.2. If you wish to stop using the Service at any time, there will be no refund for issued WBSS Cards or Provisional Cards.

    4.2. A WBSS Card will be available for you to collect from a WBSS Executive Committee Member within 14 days of us receiving your payment.

    4.2.1. You are granted the status of Member, as soon as payment is received and will have access to the relevant Members Only Services.

  5. Our Website

    5.1. Opinions expressed on this site are those of the respective contributing users only. These views do not represent those of WBSS and its Executive Committee. WBSS is not responsible for and disclaims all liability for content and comments contributed by users.

    5.2. You must not use the Blog or Forum to display any material which is:

    5.2.1. racist, sexist or homophobic

    5.2.2. pornographic, obscene, profane or vulgar

    5.2.3. defamatory of any person, entity or organisation

    5.2.4. abusive, threatening or otherwise likely to be harmful to those persons likely to use the WBSS site

    5.2.5. in contravention of any relevant local, national or international law or which incites or encourages the cotravention of any such law

    5.2.6. otherwise offensive in the opinion of WBSS

    5.2.7. infringing of the rights (including the intellectual property rights) of any legal or natural person; or

    5.2.8. related to the conduct of an organisation other than WBSS

    5.3. By posting comments on this Blog or Forum, you agree to allow the content to be re-used or quoted by WBSS without notification.

    5.4. Users sometimes include references to other websites beyond the control of WBSS. As such WBSS cannot be held responsible for the content of such websites.

    5.5. We will delete advertising posts, the Blog or Forum is not a means for advertisers to promote their websites or products. WBSS moderators will decide what is acceptable or not on a case by case basis.

  6. Things we may have to do

    6.1. Occasionally we may have to:

    6.1.1. temporarily suspend the Service (or any part of it) for operational reasons or in an emergency or for your security;

    6.1.2. bar certain users from the Service on a temporary or permanent basis in order to prevent fraud or in circumstances where we would suffer direct loss.

  7. Your Responsibilities

    7.1. You Agree

    7.1.1. and warrant that all factual information you provide to us is correct;

    7.1.2. to contact WBSS immediately if your WBSS Card is lost, stolen or destroyed or likely to be used in an unauthorised manner and to cooperate with us in our reasonable security and other checks; and

    7.2. If your WBSS Card is lost, stolen, damaged or destroyed or used without your authority, we shall have no obligation to make a refund to you as affirmed in Clause 4.

    7.3. You must not use or permit anyone else to use your WBSS Card or the Service

  8. Our Rights to Cancel Your Membership

    8.1. In addition to anything else we can do, we may cancel Your Membership at any time if:

    8.1.1. you fail to comply with the Terms and Conditions in any material way; or

    8.1.2. you contact us to report that your WBSS Card is lost, stolen or destroyed; or

    8.1.3. if you are persistently abusive, make threats, repeatedly cause a nuisance or annoyance or otherwise act illegally towards our Exec or Members, or employees of our agents; or

    8.1.4. you permit any other person claiming to be you to use the Service or your WBSS Card; or

    8.2.6. if you do anything or permit anyone else to do anything which we reasonably think adversely impacts the Service to other WBSS Members or Non-Members or is damaging to the reputation of WBSS.

    8.2.7. If your Membership is cancelled and you wish to be granted renewed Memberhsip, you must contact the WBSS Executive Committee. If we agree to reinstate you, you may have to pay a renewal fee equal to the cost of a WBSS Card unless the cancellation was due to our negligence.

  9. Limitation of Liability

    We have no liability to you other than to exercise the reasonable skill and care of a competent University Society.

  10. Matters Beyond Our Reasonable Control

    If we cannot provide the Service to you because of something beyond our reasonable control, we will not be liable to you for this.

  11. Changes to the terms and conditions

    We reserve the right to change our terms and conditions of Service from time to time. We will notify you of any changes to these terms by posting them on our website at wbss.co.uk. In addition to this we may also notify you by email.

  12. General

    12.1. If either of us fails to enforce any rights under the terms and conditions, it shall not prevent either you or us (as the case may be) from taking action later.

    12.2. These terms and conditions are governed by the laws of England and Wales.

    12.3. If you want to complain please contact WBSS using the 'contact' link on wbss.co.uk.

  13. Use and Disclosure of Information

    13.1. If you do not want to receive any communications from WBSS then you must explicitly inform us.
